Billionaire's Twitter Takeover in Question
SEC Lawsuit Settlement Sparks Debate
A US judge has approved a $1.5 million penalty levied against Elon Musk, which will settle a US Securities and Exchange Commission (SEC) lawsuit. Despite having "significant misgivings" about the settlement, US District Judge Sparkle Sooknanan has noted that her court will accept the settlement, as reported by Bloomberg.
The SEC lawsuit was filed in early 2025 over how Musk handled his takeover of Twitter. The lawsuit revolved around Musk's failure to disclose to public investors, in a timely manner, his growing stake in the company in 2022. The SEC argued that Musk's failure to disclose his stake "ultimately saved him a whopping $150 million."
In May, Musk reached a settlement with the SEC that stipulated a trust in Musk's name would be responsible for paying a $1.5 million penalty without admitting wrongdoing. Judge Sooknanan previously questioned whether Musk was receiving “special treatment" from the Trump administration, after Musk helped to bankroll Trump's campaign during the 2024 presidential race.
In her opinion, Sooknanan noted that her court was "limited to evaluating whether the proposed consent judgment meets minimum standards of fairness and reasonableness," or whether it “make[s] a mockery of judicial power.” Although she expressed significant misgivings about the settlement, Sooknanan wrote that the settlement meets the high threshold.
The settlement has sparked debate over whether Musk is receiving special treatment from the Trump administration. The controversy surrounding Musk's Twitter takeover continues to unfold, with the judge's approval of the settlement adding to the complexity of the situation.
